All commercial properties must contract with a permitted hauler to transport commercial waste within city limits. Commercial waste includes landfill garbage, recyclables, organics, construction and demolition materials, and hazardous waste.
Multifamily properties with five or more units are eligible for weekly recycling service under the City's contract with Texas Disposal Systems. All other commercial properties, at minimum, are required to subscribe to a landfill waste collection service and may elect to enroll in additional services such as recycling and composting.
The San Marcos Development Code adopted in 2018 does require new developments to provide equal enclosure space for landfill trash and recycling collection.
Although current ordinances do not require commercial properties to meet a landfill diversion metric, we encourage property owners and managers to adopt diversion programs to reduce environmental impact, support recycling markets, and help promote sustainable waste management in our community.
Any person who violates any provision of Article 3 of chapter 66 of the City Code commits a misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than $150.00 nor more than $2,000.00 for each violation.
