On Oct. 4, 2018 the Historic Preservation Commission voted to recommend that Cape's Dam be designated a historical landmark as outlined in Chapter 2, Article 5, Division 4 of the San Marcos Development Code.

The City had previously planned to remove the dam with full financial support from the U.S. Fish and Wildlife Service.
